How to Buy Property in Indonesia?

Foreigners cannot buy property in Bali or anywhere else in Indonesia through your own name at the moment. You will be able only to have "Right of Use" title valid for 25 years and extendable to another 25 years.

There are 2 methods which facilitate you to effectively to solve this problem:

A. Using Indonesian Citizen Name (Nominee).
Purchase or rental contract for property in Bali will be made out in Indonesian Name. These include transferring "Right of Previous" owner to nominee and a loan agreement for the purchase/rental price between the investor and the nominee and irrevocable and transferable power attorney to sell; Transfer or otherwise dispose of the property and to represents the nominee in any dispute regarding the property. Most foreigners using this option and point a lawyer as their nominee.

B. Using a Foreign Investment Company (PMA).
Although it will be expensive and arduous process some foreigners to have their property owned by PMA Company directly controlled by the foreign investors. Before establishment of PMA Company an application asked to be made its investment coordination board for approval of the company and its investment project. This approval is usually received after two or three months in the form of a Capital Investment Approval Letter. A PMA company can be 100 % foreign owned. The foreign investment may comprise both debt and equity (Indonesia Government Regulation No PP 20/1994), but in the other hand Indonesian ministry of investment has a rule of thumb that the ratio of debt to equity should be no more than 3:1.

Amendment to the Regulation of The State Minister of Agrarian Affairs / Chairman of the National Land Agency No 7/1996:

Foreigner May Purchase the Right of Utilization over land with the Right of Proprietorship from the Holder of the said Right of Utilization along with Houses or Purchase the Right Utilization and later contract houses on it. The Purchase of the said Right of Utilization shall be conducted pursuant to the effective stipulations that are, by virtue of a deed made by a land conveyance, which shall later be registered in the Land Office. Likewise, the requirements for construction of houses must abide by the prevailing stipulations, for example with respect to the Building Construction Permit "(IMB)".

Foreigner may own a house and obtain the title on land by means of the following:
- Purchasing or contracting a house on land with the right utilization with the right proprietorship.
- Purchasingii an Apartment house unit contracted iion land with theii right of utilization iiover State iiiLand.
- Purchasing or contracting a house on land with the right of Proprietorship or the Right of Lease oover building on the basis of a written agreement with the owner of the land title concerned.
